“BUILD – OPERATE -TRANSFER” MODEL OF PPP CONTRACTS HAS APPROVED IN AZERBAIJAN
President Ilham Aliyev issued a decree on the application of the Law of the Republic of Azerbaijan on March 15, 2016 "On Implementation of Investment Projects on Construction and Infrastructure Facilities on a Special Financing Facility".
In accordance with the Art.4 of the Law, the Cabinet of Ministers shall prepare its offers on terms of implementation of investment projects related to construction and infrastructure facilities within the framework of the "Build – Operate - Transfer" model by investors, requirements to investors in accordance with the types of construction and infrastructure facilities, the terms and conditions of the concluded contracts, the procedure for determining the value of the goods and services to be obtained as a result of investment within 2 months and present to the President of Azerbaijan Republic.
The decree states:
- The Ministry of Economy carries out the powers of the relevant executive authority provided for in Article 2.0.4 of the Law " On Implementation of Investment Projects on Construction and Infrastructure Facilities on a Special Financing Facility";
- The powers of the relevant executive authority provided for in Article 4 of this Law shall be exercised by the President of Azerbaijan.
