FIXED TERM EMPLOYMENT CONTRACTS ARE NO MORE “FRAMED”

The Parliament of the Republic of Azerbaijan passed a law approving amendments to the Labor Code of the Republic of Azerbaijan.
Pursuant to the amendments, the fixed-term employment contracts, that previously could not exceed 5 years’ period, now depend on the agreement between parties.

Moreover, from now on, the official notification period for employees, dismissed as a result of downsizing, will depend on their work experience history and the amount of compensation paid to employees dismissed on the grounds of the liquidation of an entity or downsizing will depend on the work experience of the dismissed employee.

The employee has also a right to give a consent to be compensated instead of receiving the above-mentioned notification period.
If the employment contract is terminated on the ground of changes to the labor conditions, the statutory one-month notification period to the employee can be eliminated and instead the employee can be granted a lump sum compensation, that must be not less than the average monthly salary. Although, if the part of the notification period passed, such lump sum payment shall be reduced in respective proportion as well.
